We'll review your background to see if you meet the 1st eligibility criteria for the EB-2 NIW. At this stage, our team will analyze your professional history, education, and experience.
Scheduled within 2 business days
To gain a better understanding of your profile, we will schedule a free, 30-minute call. During this call, we will discuss important aspects of your case and address any questions you may have.
1–3 days to review agreements before signing
Initial Visa Franchise Fees ($925 - $1,675)
If you are a good fit for our EB-2 NIW offering, you will need to complete our agreement by e-signature and make the initial payment. You will engage the independent attorney of your choice through a separate agreement.
Scheduled within 5 business days
After you become a Visa Franchise client, our team will arrange a consultation call with 2 or 3 immigration attorneys who are best suited to your profile. Following this call, your chosen attorney will send a separate retainer agreement for their services, which you must sign to engage them independently.
6–9 weeks to complete
Our team will initiate the development of your business/personal plan based on your proposed endeavor. For entrepreneur clients, we will provide support throughout the process of opening a U.S. company and corporate bank account. We will also assist you in obtaining a relevant tax ID, document collection, as well as review your CV if necessary.
Simultaneously, your chosen immigration attorney will work on preparing an array of documents, including but not limited to: Form I-140, your petition letter, letters of recommendation, and any documentation demonstrating that a labor certification would adversely affect the U.S. national interest, among others.
2–8 months to receive the final decision on the petition
Depending on your case, your petition might be approved in about 4 months (January 2024). If you decide to file for premium processing ($2,500 fee), the USCIS is required to provide a decision within 45 days, however, your chances of receiving an RFE increase. An RFE is not to be confused with a denial or rejection. You will be given a timeframe within which the requested information must be provided.
0-15 years (Depending on Visa Bulletin and Country of Birth)
The priority date is marked as the day the USCIS receives your I-140 petition. Be sure to check the monthly visa bulletin released by the Department of State to see if your priority date matches up with the final action date given in the EB-2 category for your birth country.
6-12 months
Once your Final Action Date is current, you can either adjust your status if you are in the U.S. under a valid nonimmigrant status, or you can go through consular processing. The median wait time for the I-485 is 9 months (January 2024). Consular processing involves making an appointment with a U.S. Consulate or Embassy in your home country and participating in a one-on-one interview with a consular officer.
