The basics

What is the E-2 essential employee visa?

It lets a company from an E-2 treaty country send key staff to work in its U.S. operation. Most European countries have this treaty with the U.S. Three things decide whether it could work for you.

Your company

The U.S. business needs a treaty nationality.

50%+owned by one treaty nationality
At least half owned by nationals of one E-2 country
Ownership can run through your European parent
A real, active U.S. operation

Your employee

The person you send needs the right profile.

Samenationality as the company
An executive or supervisory role
Or skills essential to the U.S. operation
Each employee's case prepared on its own

How it compares

Why companies look at the E-2 first.

Nolottery or annual cap
Not tied to the H-1B lottery
Can be renewed while the role continues
Spouse and children under 21 can join

General information only. Eligibility depends on each company and each role, and is assessed case by case.
